If you are an individual who is contemplating a class or have just received notice that you are a member of a class, you can Contact Me directly for names of the parties which may be in your circumstances, obtain documents or gather further information not included on the Current Actions page, or get referrals for names of attorneys which are competent in class actions.
Please Remember the Following:
| | The number of parties is important if you wish to challenge a class on the basis of fairness or wish to file or intervene so as to have a hand in the settlement.
| | | EVEN IF there is a proposed settlement when you get your class notice giving an "opt-out" deadline, you may "opt-out" and join with others who have "opted-out" and bring an independent action against the company on your own. In this case, unless your damages are very large ($100,000+ by yourself), you will need other parties to entice an attorney to take the case on a contingency basis. It is possible to bring a competing class or an independent court action against the company. The relative merits of each course should be discussed with counsel and will depend on dollar amounts, number of parties involved, etc....
| | | If you are contemplating a class, or involved in a class, against a company which does business in more than one state, it is sometimes advantageous to join with other parties in states or courts with more advantageous rules or appellate rulings. In that case, you should file in that particular state or court. (I am not even going to get into "judge shopping").
| | | The general rule is as follows: The larger the class, or the more parties involved, the easier it is to get competent counsel involved on a contingency basis and the greater your chances are of recovering damages.

2.) Whether it is your wish, or not, in having attorneys, which may be involved in the action, contact you directly or if you would prefer to acquire their name from me where you can contact them.
Remember that most states do not allow attorneys to contact (solicit) you without your request or initiation of the matter. |

If you just want to tell me to go to hell for my opinions on how the system works or for putting this information of the web.
